Visitor Access & Property Terms
These terms apply to everyone who enters, stays at or uses this private residential property, including household members, account holders and visitors.
By requesting access, creating or continuing to use an account, selecting I Agree / Open Gates, opening the gates, or entering or remaining on the property, you confirm that you have read, understood and agree to these terms.

1. Private Property
This is a private residential property.
Permission to enter is limited to the purpose and duration of your visit. Entry does not give you permission to access any area of the house, grounds, buildings or other parts of the property which have not been made available to you.
Please follow any reasonable instructions given by the property owner, occupier or another member of the household concerning access, parking, safety, animals or use of the property.
2. Conduct
These rules apply to everyone on the property, including household members, account holders and visitors.
There is a zero-tolerance policy on illegal drugs. You must not bring, use, supply or possess illegal drugs anywhere on the property.
Smoking of tobacco or any other substance is not permitted anywhere on the property. If you wish to smoke, you must leave the property completely before doing so.
You must not consume alcohol to excess on the property.
3. Your Safety
Please take reasonable care for your own safety while entering, leaving and moving around the property.
As with any private home and grounds, the property may contain ordinary residential and rural hazards, including:
- steps and changes in floor level;
- thresholds;
- gravel and loose surfaces;
- uneven paving or ground;
- grass, garden and landscaped areas;
- wet, icy or slippery surfaces;
- walls, posts and kerbs;
- reduced visibility after dark;
- vehicles and moving vehicles;
- electrically operated gates;
- machinery, tools or equipment; and
- domestic animals.
You must not enter closed, private, restricted or obviously non-public areas without permission.
If you notice anything which appears unsafe, please notify a member of the household.
4. Vehicle Access and Parking
If you bring a vehicle onto the property, you remain responsible for driving, manoeuvring and parking it safely.
Before proceeding, you must satisfy yourself that there is sufficient space and clearance for your vehicle.
You must take reasonable care to avoid:
- gates;
- walls;
- posts;
- kerbs;
- buildings;
- landscaping;
- other vehicles;
- people; and
- other property.
Except where liability cannot lawfully be excluded or restricted, the property owner and occupiers accept no responsibility for loss of or damage to a vehicle or its contents while it is on the property.
This includes accidental damage occurring while entering, leaving, manoeuvring or parking.
You remain responsible for damage caused by you or your vehicle.
5. Electric Gates — Important Access Instructions
The property is secured by electrically operated gates.
The gates do not have a vehicle or motion sensor which prevents them from closing because a person or vehicle is passing through them.
Once opened, the gates will remain open for approximately 90 seconds before beginning to close automatically.
You must therefore observe the gates yourself and make sure you have sufficient time and clearance to pass through safely.
Entering the Property
You must:
- use your own authorised access link to open the gates;
- wait until the gates are sufficiently open before proceeding;
- ensure that your route through the gates is clear;
- proceed carefully and at low speed;
- never attempt to pass through gates which have begun closing; and
- never obstruct, force or interfere with the gates or their mechanisms.
Do not follow another vehicle through the gates.
If another vehicle has entered before you, you must wait for the gates to complete their closing cycle and then use your own access link to open them again before entering.
If the gates are already open when you arrive, you must not assume that they have just opened or that sufficient time remains before they close.
You should wait for the gates to close and then initiate a new opening cycle using your own access link before entering.
Leaving the Property
There is no automatic vehicle detection or exit sensor.
The gates will not automatically detect your vehicle and open for you when you approach from inside the property.
Before leaving, you must use your authorised access link to open the gates.
You must then:
- wait until the gates are sufficiently open;
- make sure your exit route is clear;
- proceed carefully and at low speed; and
- not attempt to pass through gates which have begun closing.
Responsibility When Using the Gates
Opening the gates through the Moultons Family application does not mean that it is automatically safe to proceed.
The gate-opening function simply instructs the gates to begin their opening cycle.
You remain responsible for:
- observing the gates;
- checking your surroundings;
- ensuring sufficient vehicle and pedestrian clearance;
- making sure the gates are sufficiently open; and
- deciding when it is safe to proceed.
6. Dogs and Other Animals
Dogs live at the property.
They will normally be controlled or kept within appropriate areas, but this remains a residential property and an animal may occasionally be encountered unexpectedly.
Unless expressly invited to do so, you must not:
- approach;
- touch;
- feed;
- chase;
- tease;
- corner;
- release; or
- otherwise interfere with an animal.
If you unexpectedly encounter a dog, remain calm, give it space and follow any instructions given by a member of the household.
You must not open doors, gates, kennels, barriers or other areas used to contain animals unless authorised to do so.
If you are particularly frightened of dogs, have an allergy to dogs or have another concern relating to animals at the property, please tell the person you are visiting before arriving.
7. CCTV and Video Surveillance
CCTV and other video security systems operate in and around the property.
By entering the property, you acknowledge and understand that your image, vehicle and activities in areas covered by the security system may be recorded.
The CCTV system is operated primarily for purposes including:
- security of the property and its occupants;
- prevention and investigation of crime or unauthorised access;
- safety;
- investigation of accidents or incidents;
- investigation of damage to the property, vehicles or other belongings; and
- establishing what occurred where there is a dispute or insurance claim.
Recordings may be reviewed and, where reasonably necessary, preserved or disclosed to relevant persons such as the police, emergency services, insurers, legal advisers or other persons involved in investigating an incident or claim.
You must not interfere with, obscure, damage, disable or tamper with any camera or other security equipment.
8. Children and Dependants
If you bring a child or another person who requires your supervision onto the property, you remain responsible for supervising that person appropriately.
Children must not be allowed to:
- operate the electric gates;
- enter restricted areas;
- approach animals without permission; or
- play around vehicles, gates or access routes unsupervised.
9. Personal Property
You remain responsible for your own possessions and valuables while visiting.
Except where liability cannot lawfully be excluded or restricted, the property owner and occupiers accept no responsibility for loss, theft or accidental damage to personal possessions brought onto or left at the property.
10. Damage to the Property
You must take reasonable care of the property and its contents.
You may be responsible for the reasonable cost of repairing, cleaning or replacing property damaged as a result of your deliberate, reckless or negligent actions.
This includes damage to:
- the house and contents;
- gates and access equipment;
- vehicles;
- driveway and paving;
- gardens and landscaping; and
- any other property belonging to the owners, occupiers or another visitor.
11. Visitors You Bring With You
If another person accompanies you, you are responsible for ensuring that they are authorised to enter and are made aware of any relevant access and safety instructions.
Where practical, each adult visitor should accept these terms individually.
12. Liability
Nothing in these terms is intended to exclude or restrict liability where doing so would be unlawful.
Subject to that qualification, you accept responsibility for loss, damage or injury arising from:
- your own negligent, reckless or deliberate actions;
- failure to follow reasonable instructions;
- entering an unauthorised or restricted area;
- misuse or interference with gates, equipment or animals;
- attempting to follow another vehicle through the gates;
- attempting to pass through closing gates; or
- unsafe operation of your own vehicle.
These terms do not remove any legal duty which an owner or occupier of the property cannot lawfully exclude.
13. Acceptance
Account holders agree to these terms when they accept them for their account. Visitors agree by selecting I Agree / Open Gates. In either case, you confirm that:
- you have read and understood these terms;
- you understand that you are entering private residential property;
- you understand how the automatic gates operate;
- you understand that the gates have no vehicle or motion sensor preventing them from closing;
- you understand that you must initiate a fresh gate-opening cycle when entering and leaving;
- you will not follow another vehicle through the gates;
- you understand that CCTV operates at the property;
- you will follow reasonable safety and access instructions;
- you will take reasonable care for yourself and anyone accompanying you;
- you will not bring, use, supply or possess illegal drugs on the property;
- you will not smoke tobacco or any other substance on the property, and will leave the property completely before smoking;
- you will not consume alcohol to excess on the property; and
- you accept responsibility for your own actions and for damage caused by you.
